DECK. Once general contract is signed, Customer warrants that the roof decking is sustained to work and capable to withstand roof construction, operations, and equipment. Lummus Steel LLC only inspects a roof deck for visual defects. Lummus Steel is not responsible for any negative structural integrity of decking or quality of construction prior to beginning work, unless re sheathing of roof is required. Lummus Steel is not responsible to test or assess moisture content of the deck or substrate.

ASBESTOS AND TOXIC MATERIAL. This proposal deems that Lummus Steel will not being coming into contact with Asbestos-Containing toxic Materials(ACM). Lummus Steel shall be compensated for additional expenses resulting from the presence of ACM. Customer agrees to indemnify Lummus Steel from and against any liability, damages, losses, claims, demands or citations arising out of the presence of ACM.

RIGHT TO STOP WORK. Lummus Steel has the right to stop working when the customer either breeches of contract and/or payment is not received. This includes any deliveries, warranties, materials, and labor. If labor has already started, Lummus Steel will not be liable for water damage if customer breeches contract or does not submit t payment that is due. The time period in which Lummus Steel had to work will be extended. As for the suspended time Lummus Steel had to delay, stop, and start; The Contract sum will be increased.

PAYMENT. Unless stated other wise, Customer is required to pay material cost upfront and 50% labor price when halfway through, and the remaining 50% whenever job is finished to Lummus Steel standards. Shall customer reject any payments, Lummus steel shall be entitled to recover from Customer all costs of collection incurred by Lummus Steel, including attorney’s fees, resulting from Customer’s failure to make proper payment when due.
